These terms apply to this website and to all apps published by XI05 Labs LLC ("we", "us", "our"), unless an app provides its own terms, in which case those terms govern for that app. By using our website or apps, you agree to these terms. If you do not agree, do not use them.

License

We grant you a personal, non-exclusive, non-transferable, revocable license to use our apps for their intended purpose, subject to these terms and to the terms of the store you obtained them from (such as the Apple App Store or Google Play). Where a store's own license terms apply, such as Apple's standard EULA, those terms control for that copy of the app.

Acceptable use

You agree not to reverse engineer, decompile, or disassemble our apps except where permitted by law; not to use them for unlawful purposes; and not to resell, sublicense, or redistribute them without our written permission.

Purchases

All purchases and subscriptions are processed by the store operator under its terms. Prices, features, and availability may change at any time. Refunds are governed by the store operator's policies.

Intellectual property

Our apps, this website, and all associated names, logos, designs, and content are the property of XI05 Labs LLC or its licensors and are protected by copyright, trademark, and other laws. These terms do not grant you any rights in our trademarks or branding.

Third-party services

Our apps and website may link to or rely on services operated by third parties. We are not responsible for third-party services, their content, or their terms and privacy practices.

Disclaimer of warranties

To the maximum extent permitted by law, our apps and website are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our apps will be uninterrupted, error-free, or secure, or that defects will be corrected.

Limitation of liability

To the maximum extent permitted by law, XI05 Labs LLC and its members, officers, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or business, arising out of or related to your use of our apps or website, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability for any claim will not exceed the amount you paid us for the app giving rise to the claim in the twelve months before the claim arose, or fifty US dollars, whichever is greater. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnification

You agree to indemnify and hold harmless XI05 Labs LLC from claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of our apps or website or your violation of these terms.

Changes and termination

We may update, change, or discontinue any app or feature at any time without notice. We may update these terms by posting a revised version on this page with a new effective date; continued use after changes take effect constitutes acceptance. We may suspend or terminate your license if you violate these terms.

Governing law

These terms are governed by the laws of the state in which XI05 Labs LLC is organized, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in that state, and you consent to their jurisdiction.

Severability

If any provision of these terms is found unenforceable, the remaining provisions remain in full effect.
